Terms of Service
Welcome to Widgit ("Platform", "we", "our", or "us"). By accessing or using our website, services, marketplace, applications, or integrations, you agree to these Terms of Service. If you do not agree to these Terms, please do not use the Platform.
1. About the Platform
Widgit is a platform designed for content creators and streamers. The Platform allows users to connect third-party services, install and manage streaming widgets and buy or sell digital widgets through our marketplace.
Widgets available on the Platform are software-based tools that integrate with user accounts and services. Unless explicitly stated otherwise, purchasing or installing a widget does not grant ownership of its source code.
2. Eligibility
You must be at least 13 years old, or the minimum age required to provide digital consent in your country, to use the Platform.
By using the Platform, you confirm that you have the legal authority to accept these Terms and that your use of the Platform complies with applicable laws. You are responsible for maintaining the security of your account and for all activities that occur under your account.
3. Account Security
Some Platform features require an account. You agree to provide accurate information, keep your login credentials secure, and notify us if you believe your account has been accessed without authorization.
You are responsible for activity that occurs through your account, including activity by anyone you authorize to use your account or connected streaming services.
4. Third-Party Integrations
The Platform may connect with third-party services such as Google, YouTube, Twitch, Kick, Ko-fi and other supported providers.
By connecting a third-party account, you authorize us to access information and perform actions necessary to provide requested Platform functionality. Your use of third-party services remains subject to their own terms, policies and requirements.
We are not responsible for the availability, accuracy, policies, security, or operation of third-party services, and third-party service changes may affect Platform functionality.
5. Google API Services
Certain Platform features use Google APIs and Google user data. Information received from Google APIs is used solely to provide and improve Platform functionality.
We do not sell Google user data and we handle such data in accordance with our Privacy Policy and applicable Google API requirements. Users may revoke Google access at any time through their Google Account settings.
Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements where applicable.
6. Marketplace and Widgets
The Platform includes a marketplace where users may acquire, install, and distribute digital widgets. Widget creators retain ownership of their intellectual property unless otherwise stated.
Users may not copy, redistribute, resell, reverse engineer, or attempt to extract source code from widgets except where expressly permitted by law or by the widget creator. We do not guarantee the performance, compatibility, availability or functionality of third-party widgets.
Creators are responsible for the widgets, descriptions, media, support promises, and other materials they submit. Buyers are responsible for reviewing widget details before purchase or installation.
7. Payments, Fees, and Orders
Paid marketplace transactions may be processed by third-party payment providers such as Stripe, PayPal, or other supported providers. Payment providers may apply their own terms, fees, dispute processes, identity checks, and payout requirements.
We may delay, cancel, limit, refund, withhold, or reverse transactions where we reasonably believe fraud, abuse, chargeback risk, sanctions risk, payment error, policy violation, or unauthorized activity may be involved.
Unless otherwise required by law or stated at checkout, digital widget purchases and marketplace fees may be non-refundable once fulfilled, installed, downloaded, or otherwise made available.
8. User Content and Submissions
The Platform may allow you to submit, upload, display, sell, publish, or transmit widget code, media, profile information, marketplace listings, messages, reports, and other content.
You retain ownership of your content, but you grant Widgit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, modify for technical formatting, and otherwise use your content as needed to operate, protect, promote, and improve the Platform.
You represent that you have all rights and permissions needed for the content you submit and that your content does not violate any law, third-party right, platform policy, or these Terms.
9. Prohibited Content and Conduct
You agree not to:
- Violate any applicable law or regulation
- Upload, distribute, sell, or install malicious software, spyware, credential harvesters, hidden miners, or harmful code
- Attempt unauthorized access to accounts, systems or data
- Interfere with the security or operation of the Platform
- Circumvent rate limits, access controls, payment controls, security features, or usage restrictions
- Copy, scrape, or use automated systems to access the Platform in a way that burdens, disrupts, or abuses our services
- Impersonate another person or misrepresent your relationship with Widgit, a creator, a buyer, or a third-party platform
- Submit content that is unlawful, infringing, fraudulent, deceptive, defamatory, harassing, hateful, sexually exploitative, invasive of privacy, or otherwise harmful
- Use the Platform for illegal gambling, illegal weapons activity, terrorism, unauthorized financial activity, or other unlawful purposes.
You are solely responsible for your actions, content, and use of connected services.
10. Reports and Enforcement
We may review, remove, disable, reject, or limit content, widgets, listings, accounts, integrations, purchases, or payouts if we believe they violate these Terms, third-party platform requirements, applicable law, or the safety and integrity of the Platform.
To report content, conduct, marketplace listings, or account activity that may violate these Terms, contact us at widgithub@gmail.com. Intellectual property reports should include enough detail for us to identify the allegedly infringing material and the rights at issue.
11. Availability and Changes
We strive to provide a reliable service but do not guarantee uninterrupted availability. Features, widgets, integrations, and marketplace services may be modified, suspended, or discontinued at any time due to maintenance, technical issues, security concerns, third-party service changes or other operational reasons.
12. Intellectual Property
All Platform software, branding, logos, designs, documentation and content are owned by or licensed to Widgit. Except as expressly permitted, no part of the Platform may be copied, modified, distributed or used without authorization.
Widgit names, logos, designs, and branding may not be used in a way that suggests sponsorship, endorsement, or affiliation without our prior written permission.
13. Third-Party and Open Source Software
Parts of the Platform, widgets, or integrations may include third-party or open source software subject to separate license terms. Those separate terms apply only to the applicable third-party or open source components.
14. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store and protect personal information and connected account data.
15. Disputes Between Users
Widgit may provide tools for creators, buyers, viewers, and other users to interact, but we are not responsible for user conduct, creator promises, buyer expectations, third-party stream activity, or disputes between users.
You release Widgit from claims arising out of your interactions with other users, marketplace participants, viewers, creators, or third-party services to the fullest extent permitted by law.
16. Termination
We may suspend or terminate access to the Platform if you violate these Terms, misuse the Platform, create security risks or engage in unlawful activity. You may stop using the Platform and delete your account at any time.
After termination, you must stop using the Platform. Sections that by their nature should survive termination, including intellectual property, user content licenses, privacy, disclaimers, limitation of liability, indemnity, independent contractors, assignment, YouTube API Services, and general provisions, will continue to apply.
17. Disclaimer
The Platform, marketplace, widgets, integrations and services are provided on an "as is" and "as available" basis. We do not guarantee that the Platform, widgets or third-party integrations will always be available, error-free, secure or uninterrupted.
We do not warrant, endorse, or guarantee user content, third-party widgets, marketplace listings, creator submissions, third-party services, stream events, chat messages, viewer actions, or payment provider services.
18. Limitation of Liability
To the maximum extent permitted by law, we are not responsible for any losses, damages, lost profits, lost revenue, lost data or service interruptions resulting from the use of the Platform, marketplace listings, widgets or third-party services. Your use of the Platform is at your own risk.
19. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Widgit from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Platform, your content or widgets, your marketplace activity, your violation of these Terms, or your violation of any law or third-party right.
20. Independent Contractors
You and Widgit are independent contractors. These Terms do not create a partnership, joint venture, employment, franchise, fiduciary, or agency relationship between you and Widgit. You may not make commitments or representations on Widgit's behalf.
21. Assignment
You may not transfer or assign these Terms, your account, or your rights to use the Platform without our prior written permission. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of the Platform.
22. YouTube API Services
Widgit uses YouTube API Services to provide YouTube-connected widgets, overlays, counters, event feeds, live chat features, and related creator tools. By using YouTube-connected Platform features, you agree to be bound by the YouTube Terms of Service.
Your use of YouTube-connected features is also subject to the YouTube API Services Terms of Service, the YouTube API Services Developer Policies, and Google's applicable privacy and security requirements.
You may revoke Widgit's access to your Google or YouTube account through your Google account permissions. YouTube or Google may modify, suspend, audit, or terminate access to YouTube API Services under their own terms, which may affect YouTube-connected Platform features.
23. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
24. General
These Terms, together with our Privacy Policy and any additional terms presented for specific features, constitute the agreement between you and Widgit regarding the Platform.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
